Terms of Use
These terms are an agreement between you and Honey Dog Media LLC, a Minnesota company ("we", "us"), for using the GoodGame app and gogoodgame.com. By using GoodGame, you agree to them. If you don't agree, please don't use GoodGame.
The short version
- You're the operator. You're responsible for what you stream.
- Before you stream a team, get the permission of the team or association, and follow its policy on filming and streaming players.
- Your stream goes to your YouTube channel, under YouTube's Terms of Service.
- Broadcasts GoodGame creates are Public unless you choose otherwise.
- GoodGame is in beta. It may change, and it may not always work.
- If something goes wrong, our liability is limited to $100.
- Disputes go to individual arbitration, not to court or class actions. You can opt out within 30 days.
1. Who can use GoodGame
You must be at least 18. If you use GoodGame for a team, club, school or association, you confirm you're allowed to act for it, and these terms apply to it too.
2. YouTube
GoodGame streams to YouTube and uses YouTube API Services. By using GoodGame's YouTube features, you agree to be bound by the YouTube Terms of Service. Google's use of your information is covered by the Google Privacy Policy.
Your stream is published on your own YouTube channel. You're responsible for your channel and for following YouTube's rules, including its Community Guidelines. You can remove GoodGame's access to your channel at any time with DISCONNECT in the app or at https://security.google.com/settings/security/permissions.
GoodGame isn't made or endorsed by YouTube or Google.
3. Streaming youth sports: permission and responsibility
GoodGame is made for youth sports, so your streams will often show children. That makes your responsibilities as the operator important.
- Get permission first. Before you stream or record a game, you must have the permission of the team or association you're streaming for.
- Follow their policy. You must follow the team's or association's policy on filming and streaming players, including any parent or guardian consent or opt-outs it requires, and the rules of the venue and the league.
- Respect requests. If a parent, guardian, coach or official asks you to stop streaming, to keep a player out of view, or to take a video down, follow the team's or association's policy in responding.
- Think about what's shown. Don't stream or display anything that identifies a child beyond what the team's policy allows, such as full names, schools or locations.
Broadcasts GoodGame creates are Public unless you choose otherwise, so anyone can find and watch them on YouTube. They're marked not made for kids. If the team's or association's policy calls for it, make the broadcast Unlisted (only people with the link can watch) or Private. You can choose this when GoodGame sets up the broadcast, or change it in YouTube Studio at any time. The setting you choose must fit the team's or association's policy.
4. Your content
Your team names, logos, sponsor images, messages, streams and recordings are yours. They stay on your phone and on your YouTube channel; we don't receive them unless you send them to us, for example in a bug report. You confirm you have the right to use everything you put in a stream, including team and sponsor logos and any music.
Sponsorship deals are between your team and the sponsor. We're not part of them, even when GoodGame shows a sponsor's graphics or counts its airtime.
If you send us ideas, suggestions or feedback, we may use them freely, without owing you anything.
5. Using GoodGame fairly
Don't use GoodGame to break the law, infringe anyone's rights, harass or harm anyone, or stream content that isn't allowed on YouTube. Don't try to copy, reverse engineer or interfere with the app, except where the law allows it.
6. The app and Apple
We give you a personal, non-exclusive, non-transferable license to use GoodGame on Apple devices you own or control, as Apple's rules allow, under these terms. GoodGame and its name, logos and design belong to Honey Dog Media LLC.
You get GoodGame through Apple: TestFlight during the beta, and later the App Store. Apple's standard Licensed Application End User License Agreement also applies, and so do Apple's TestFlight terms for beta versions. Because you got GoodGame through Apple:
- These terms are between you and us, not Apple. We, not Apple, are responsible for GoodGame and its support, and for handling any claim about it, including a claim that it breaks a law or infringes someone's rights.
- Apple has no duty to provide maintenance or support for GoodGame.
- If GoodGame fails to meet a warranty that applies by law, you can tell Apple, and Apple will refund what you paid for it, if anything. Apple has no other warranty duty for GoodGame.
- You confirm you're not in a country under a US government embargo and not on a US government list of prohibited or restricted parties.
- Apple and its subsidiaries can enforce these terms against you.
7. Beta
GoodGame is in beta. Features may change or be removed, and streams or recordings may fail, drop or be lost. Don't rely on GoodGame as the only record of a game that matters to you.
8. No warranty
GoodGame is provided "as is" and "as available". To the fullest extent the law allows, we make no promises about it, including that it will be error-free, uninterrupted or fit for a particular purpose. We don't control YouTube, Google, Apple, your phone or your internet connection.
9. Limits on our liability
To the fullest extent the law allows, Honey Dog Media LLC isn't liable for indirect, incidental, special, consequential or punitive damages, or for lost data, recordings, profits or goodwill. Our total liability for all claims about GoodGame is limited to $100 (US dollars). Some places don't allow these limits, so they may not apply to you.
10. Your responsibility to us
If someone makes a claim against us because of what you streamed or recorded with GoodGame, or because you broke these terms (for example, by streaming without the permission described in section 3), you agree to cover our reasonable costs of that claim, to the extent the law allows.
11. Ending
You can stop using GoodGame at any time by deleting the app. We may suspend or end your use of GoodGame if you break these terms, or stop offering GoodGame. Sections 4, 8 to 12 and 15 still apply afterwards.
12. Law and disputes
Talk to us first. If you have a dispute with us, email [email protected] with your name, what happened and what you'd like us to do. We'll do the same if we have one with you. We'll both try in good faith to settle it within 60 days before either of us starts a case.
Arbitration, not court. If we can't settle it, it will be decided by binding arbitration before one arbitrator, run by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. We'll pay the fees those rules assign to the business. The arbitration can be held by video or phone, or in the county where you live.
Individual claims only. You and we each give up the right to a jury trial and the right to bring or join a class action, class arbitration or any other representative case. Claims can only be brought individually. If a court decides this paragraph can't be enforced for a claim, that claim goes to court as described below, never to class arbitration, and the rest of this section still applies.
Exceptions. Either of us can bring an individual claim in small-claims court instead. Either of us can go to court to stop someone misusing intellectual property, for example copying the app.
Opting out. You can opt out of arbitration within 30 days of first agreeing to these terms. Email [email protected] with your name and the words "arbitration opt-out". Opting out doesn't change the rest of these terms.
Changes to this section. If we change this section, you can reject the change by emailing us within 30 days of it taking effect. The version you agreed to before then still applies to you.
Law and courts. Minnesota law governs these terms, without regard to its conflict-of-laws rules. Any case that goes to court rather than arbitration will be handled in the state or federal courts in Hennepin County, Minnesota, unless the law where you live says otherwise.
13. Changes
We may update these terms. We'll post the new version here with a new effective date. If you keep using GoodGame after that, you accept the new terms.
14. Privacy
Our Privacy Policy explains what GoodGame does with information.
15. General
- If a court or arbitrator finds part of these terms can't be enforced, the rest still applies.
- If we don't enforce a term right away, we can still enforce it later.
- We may transfer these terms to a company that takes over GoodGame. You can't transfer them without our written agreement.
- These terms, the Privacy Policy and the Apple terms in section 6 are the whole agreement between you and us about GoodGame.
